The Civil Liability Act forms the basic foundation for deciding cases and disputes that involve accidents and injuries suffered, particularly during commercial activities. Based on the information given case study, the scenario is directly related to the tort of negligence. Deriving from the Civil Liability Act 2002, there are three elements of negligence that needs to be proven before the jury. Annie had fractured her lower back after a heavy fall when she slipped after stepping on an awful mess on the floor of a bar where Brett was working. Based on the Civil Liability Act 2002, Bre tt can be held responsible for the injuries and losses suffered by Annie, and therefore, Annie is planning to file a legal suit against Brett for negligence. For one to win a case of negligence, he or she must prove that the claimant had a responsibility of care, which he breached, and the result of the breach caused significant harm to the plaintiff.[2] In this regard, Annie needs to prove that Brett had a duty of care over her; however, Brett breached the duty of care, and a result, she ended up with a fractured lower back. Firstly, Annie can prove that Brett had the duty of care over her. Based on the information from the case study, Brett is charged with the duty of care for all clients who come to Tavern Bar; therefore, Brett had a legal duty to protect Annie from any injury under the circumstances. According to the scenario, it is the responsibility of Brett to clear any mess on the floor that poses any danger to the clients of Tavern Bar. It is legally binding that Brett should act in a reasonable manner to remove all sources of danger because he owes a legal duty of care to them; however, he failed to check and ensure that the vomit on the floor was cleared to ensure the safety and security of all clients at the bar. The claimant was held responsible for the ankle injury because the action was not reasonable. Besides, he made the decision to jump while in his right state of mind. Under the principles of the Novus actus interveniens, the defendant was held responsible only for the loss suffered by the claimant at the place of work. Thirdly, Annie can prove that the breach of a duty of care by Brett caused her fall and the subsequent fracture in the lower back. According to , the defendant needs to prove that the defendant could have foreseen that his action or omission would result in injuries.[5] In criminal law, causation refers to the relationship between the cause and the effect of the defendants act, for example, the harm suffered by the plaintiff. The action of the defendant can lead to a series of events that may cause harm to the victim.[8] The chain of causation can be broken by acts of nature, third parties, and the actions of the claimant.[9] According to the concepts of novus actus interveniens, there are instances when the claimant can be charged with the liability that comes along with the losses and damages involved, for example when such damages are foreseeable.[10] Under such circumstances and based on the principles of novus actus interveniens, the jury is able to establish that there was a break in the chain of causation. For the claimant to be held responsible for the losses and damages, it must be established that the decision of the victim was reasonable based on the pertinent circumstances.[11] In this regard, the claimant must be proven to be in a sound stable state of mind during the action under investigation. If the claimant was in the r ight state of mind, then the jury will be able to establish that the action was not reasonable and, hence, breaking the chain of causation. In such cases, the claimant will be held responsible for the damages suffered. If the action leading to the damages was reasonable and made when the claimant was in an unstable mental state, the defendant will be held responsible by the jury. This is because, in an unstable state of mind, the claimant cannot be said to have broken the chain of causation. Here, it is purely the actions of the defendant that contribute to the damages. An example of where it was established that the defendant was responsible for the actions of the victim is illustrated in the case Royal v The Queen (1991) 172 CLR 378 as explained by Brown et al.[12] In this case, the defendant was held responsible for the death of the victim because the chain of causation was not broken. The defendant assaulted the deceased in their apartment after an argument, and the deceased jumped through the window to avoid harm caused by the defendant. Similarly, Annie was in an unstable state of mind as a result of intoxication from tequila that she drank; hence, she could not see and avoid the awful mess l ike the other did. Rights and Remedies Based on the data given in the case study, the right and remedy that Annie is entitled to are the compensation for the damages that she as suffered as a result of the injury on her lower back. Damages refer to the financial compensations that are given to the claimant by the defendant as a result of the injuries suffered due to a breach of the duty of care.[13] There are several types of damages that Annie can claim compensation, and I would advise her to settle on the following as remedies for her injuries. The first remedy is the pecuniary loss, which is a type of damage that come as a result of an actual and future loss in financial income as well as other expenses that are associated with the tort of negligence such as traveling and medical expenses. The plaintiff is entitled to the recovery of all the expenses that are reasonably incurred as a result of the injury. In the case study, Annie reasonably incurred expenses of clearing her medical bills. She will also incur expenses of traveling to the hospital for check-ups in the near future. Therefore, as a remedy, she will need to be compensated for accrued expenses as a portion of special damages. Besides this, all the future expenses should be calculated and awarded to her accordingly. Annie is also entitled to non-pecuniary damages, which are compensations for significant pain and sufferings experienced by the plaintiff.[14] In the case study, Annie suffers a fracture at her lower back, and this makes her vulnerable to a lot of pain during the treatment and healing process. Therefore, Brett should compensate her for the actual and prospective pain and suffering. Annie has the right to be compensated for the actual and prospective loss that she will suffer now that she will not be able to do her part-time job. The legal issue and ethics involved in this scenario is a case of negligence. Brett was legally bound by the duty of care to protect all the clients of Tavern bar from suffering any injury within the bar; however, it is due to his breach of a duty of care that Annie suffered a fractured lower back. Annie can sue Brett on the claims of negligence. Brett did not take the responsibility of cleaning the awful mess while he could reasonably foresee that is posed a danger of causing injury to clients entering or leaving the bar. The omission caused the fall and the fracture of Annies lower back. As a result, she has suffered losses that should be compensated. As a result, the remedies involved in the case study include pecuniary and non-pecuniary damages that she has suffered from medical expenses. The Bay Of Pigs The Bay of Pigs Invasion. The story of the failed invasion of Cuba at the Bay of Pigs is one of mismanagement, overconfidence, and lack of security. The blame for the failure of the operation falls directly in the lap of the Central Intelligence Agency and a young president and his advisors. The fall out from the invasion caused a rise in tension between the two great superpowers and ironically 34 years after the event, the person that the invasion meant to topple, Fidel Castro, is still in power. To understand the origins of the invasion and its ramifications for the future it is first necessary to look at the invasion and its origins. Part I: The Invasion and its Origins. The Bay of Pigs invasion of April 1961, started a few days before on April 15th with the bombing of Cuba by what appeared to be defecting Cuban air force pilots. At 6 a.m. in the morning of that Saturday, three Cuban military bases were bombed by B-26 bombers. The airfields at Camp Libertad, San Antonio de los Baos and Antonio Maceo airport at Santiago de Cuba were fired upon. Seven people were killed at Libertad and forty-seven people were killed at other sites on the island. Two of the B-26s left Cuba and flew to Miami, apparently to defect to the United States. The Cuban Revolutionary Council, the government in exile, in New York City released a statement saying that the bombings in Cuba were . . . carried out by 'Cubans inside Cuba' who were 'in contact with' the top command of the Revolutionary Council . . . . The New York Times reporter covering the story alluded to something being wrong with the whole situation when he wondered how the council knew the pilots were coming if the pilots had only decided to leave Cuba on Thursday after . . . a suspected betrayal by a fellow pilot had precipitated a plot to strike . . . . Whatever the case, the planes came down in Miami later that morning, one landed at Key West Naval Air Station at 7:00 a.m. and the other at Miami International Airport at 8:20 a.m. Both planes were badly damaged and their tanks were nearly empty. On the front page of The New York Times the next day, a picture of one of the B-26s was shown along with a picture of one of the pilots cloaked in a baseball hat and hiding behind dark sunglasses, his name was withheld. A sense of conspiracy was even at this early stage beginning to envelope the events of that week. In the early hours of April 17th the assault on the Bay of Pigs began. In the true cloak and dagger spirit of a movie, the assault began at 2 a.m. with a team of frogmen going ashore with orders to set up landing lights to indicate to the main assault force the precise location of their objectives, as well as to clear the area of anything that may impede the main landing teams when they arrived. At 2:30 a.m. and at 3:00 a.m. two battalions came ashore at Playa Gir?n and one battalion at Playa Larga beaches. The troops at Playa Gir?n had orders to move west, northwest, up the coast and meet with the troops at Playa Larga in the middle of the bay. A small group of men were then to be sent north to the town of Jaguey Grande to secure it as well. When looking at a modern map of Cuba it is obvious that the troops would have problems in the area that was chosen for them to land at. The area around the Bay of Pigs is a swampy marsh land area which would be hard on the troops. The Cuban forces were quick to react and Castro ordered his T-33 trainer jets, two Sea Furies, and two B-26s into the air to stop the invading forces. Off the coast was the command and control ship and another vessel carrying supplies for the invading forces. The Cuban air force made quick work of the supply ships, sinking the command vessel the Marsopa and the supply ship the Houston, blasting them to pieces with five-inch rockets. In the end the 5th battalion was lost, which was on the Houston, as well as the supplies for the landing teams and eight other smaller vessels. He says that she is â€Å"a slave from the start. Yes, a slave! You give up everything, your whole freedom. If you want to break your chains afterwards, you will not be able to† (Dostoyevsky p. 64). This quote undoubtedly exposes Underground Man’s awful perspective on Liza. He believes that L iza is property, rather than a human being. Also, the quote shows that he is stripping Liza of any hope for the future. He does so by telling Liza that if she ever wanted to stop prostituting, she would not be able to.Despite all of the awful accusations that he makes, Liza patiently listens although it is hurting her tremendously. Furthermore, this emphasizes the contrast in characters. It evident that Liza is truly good and that the Underground Man is relentless. However, this not the only altercation that sheds light on this notion. Moreover, there is also another conflicts that give a defined distinction between what is good and bad. The underground Man goes on to further insult Liza without a will to stop.He states, â€Å"I know that I have only to whistle and you have to come with me whether you like it or not. I don’t consult your wishes, but you mine† (p. 69). The underground Man is dehumanizing Liza by comparing her to a dog. He claims that Liza will come to h im just as a dog follows a master’s command without question. As if that insult were not enough, he proceeds to tell Liza that she must grant his every desire but he does not care for her wishes. Undoubtedly, the quality of being able to hurt Liza in such a manner is horrible.Liza’s pain is illustrated when the novel states that â€Å"She bit the pillow, bit her hand till it bled (I saw that afterwards), or, thrusting her fingers into her disheveled hair, seemed rigid with the effort of restraint, holding her breath and clenching her teeth† (p. 72). This quote actively portrays how the Underground Man’s negative qualities truly affect her. It not only pained her emotionally to hear these things, but also physically. Despite her emotions, Liza put her feelings behind her and forgives him.After he apologizes, he states, â€Å"she squeezed my hand in her fingers so tightly that I felt I was saying the wrong thing and stopped†(p. 73). This excerpt trul y shows Liza’s nobility. Although Liza is so hurt, she makes him feel like he should not have to apologize. She does this by squeezing his hand. However, this is not the only time where Liza puts the Underground Man before herself. Liza’s responses in situations with the Under Ground man portray her comforting qualities and expose his poor qualities. Previously, the audience noted that while Liza cries, the Underground Man did not comfort her.However, in later text, the tables turn. When the Under Ground Man began to cry, she did not waste time in asking what was wrong by asking, â€Å"What is the matter? What is wrong? † she cried, fussing about me† (p. 83). This quote depicts that Liza is a compassionate person. It also shows the difference between the Underground Man and her. It was her natural instinct to help him yet he did not help Liza in her time of need. This again shows that Liza is naturally good while the underground man is uncompassionate.The last encounter that the Underground Man has with Liza truly shows her positive characteristics. After some time, Liza believes that he no longer sees her as a prostitute, but as a companion. However, after having relations with the Underground Man, he wants her to leave and gives her money for the relations that they previously had. Although this hurts her beyond belief, she leaves the money. The underground man states â€Å"I saw a crumpled blue five- rouble note, the one I had thrust into her hand a minute before† (p. 89). This shows that Liza is admirable in dignity.Although she had been hurt, she still had her dignity and that was important for the Underground Man to see. Liza is placed in the novel to show that despite negative situations, a person can still posses an admirable personality. Truly, Liza continuously finds herself to be in horrible situations but she never fails in acting graciously. In a sense, Liza is an inspiration to all. She shows the audience that he r profession pains her and that she regrets it. Not only can the audience learn from her mistakes, but also from her gracious personality as well.

These gods were believed to control everything, and if the Egyptians pleased them they would be rewarded. They worshipped their gods by making offerings. They would leave flowers and food in temples to show their respect. Commoners were not often allowed in temples. Priests had plenty of power because the gods were often feared. Most Egyptians did not actually love the gods, but feared their wrath. Commoners could occasionally attend ceremonies. At these ceremonies animals were often sacrificed. Ancient Egyptians believed that if they lived a good life that they would be allowed to live in a paradise in death. When an Egyptian would die, they would be mummified. Properly burying and preserving the body was very important because they believed that the soul would not actually disconnect from the body. Organs deemed important were put in jars and buried with the body. The heart was left inside the body. Once the body was cured in preserving solutions, it was then wrapped in linen cloths.
